Terms & Conditions

 

Pricing:

Maxim Tours will make very effort to keep pricing as presented but reserves the right to adjust pricing in the event of unforeseen circumstances.

Forms of Payment:

We accept American Express, Visa, MasterCard and Discover credit and debit cards. We also accept wire transfers, cashier’s checks and personal checks. If you would like to make a payment as a wire transfer, please contact your travel specialist to obtain our banking information. Reservations will not be confirmed until initial deposit has cleared. By agreeing to these terms the traveler authorizes Maxim Tours to charge the credit card/s provided.

Itinerary Changes:

For itineraries, once finalized and booked each change is subject to a $100 change fee, as well as any cost increase. Changes are also subject to availability. Please contact Maxim Tours to request any changes to your reservations. For cancellations, please see the section on Cancellations, below.

Visas/Special Permits:

You are responsible for obtaining any necessary visas and travel permits for all countries that you will be traveling to or transiting through, and for informing yourself as to which countries/areas within countries require visas and/or special permits. Visa and entry requirements may vary depending on your nationality, the length of your stay, and the purpose of your visit, among other factors. Visa information and visas can be obtained by contacting the Consulate or Embassy of the countries involved. Please also make certain that your passport is valid for at least six months after the latest expected end date of your planned trip, as some countries will not allow entry if your passport will expire sooner. We are not lawyers, and nothing we say should be interpreted as legal advice concerning visas, entry requirements, immigration, or residency.

Health and Safety Matters:

You are responsible for determining what, if any, vaccinations or other health or safety precautions are necessary or recommended for your destinations. We are not physicians, and nothing we say should be interpreted as professional medical advice. Government health advisories can be found at: http://www.cdc.gov and http://www.who.int

Covid19:

You are responsible for understanding and adhering to all entry and travel protocols required by each country you are visiting. Any quarantine or deviation required due to Covid19-type illness, positive Covid19 test result, or any other illness or circumstance, failure to comply with protocols, and any additional costs incurred as a result, are the responsibility of the traveler. Maxim Tours is not responsible for any changes or interruptions caused by Covid19 regulations. Covid19 testing is operated by third-party companies. Any failure by the Covid19 testing company to provide results in the required time is not the fault of Maxim Tours or our affiliates. Delayed test results may result in disruption and added expense to an itinerary and any additional costs will be the responsibility of the traveler. Travelers undertake their trip with the understanding that Covid19-related disruptions are possible and these are not the fault of Maxim Tours . Government health advisories can be found on the internet at: http://www.cdc.gov and http://www.who.int

Unexpected Changes:

No revisions to the itinerary, accommodations, or trip price are planned. However, due to the unpredictability of certain countries, Maxim Tours Ltd. reserves the right to make whatever adjustments are necessary to the price in order to cover increases in, but not limited to, fuel, taxation, accommodation, exchange rates, transfers and meals. All prices are subject to change prior to final payment. If the itinerary must be changed because of, but not limited to, inclement weather, Acts of God, flight delays or cancellations, airline or vendor bankruptcy, government intervention, sickness, pandemics or other problems, additional costs may be incurred and would be the responsibility of the travelers. Maxim Tours Ltd is not responsible for missed services and accommodation due to airline schedule changes or flight cancellations for any reasons. Local tours described in the itinerary are deemed accurate but are subject to change based on local conditions and the unpredictable nature of the countries in which we work.

Pricing:

Maxim Tours Ltd. is a full service tour wholesaler. All tours are sold as complete packages and we do not itemize individual costs.

Complaints:

While Maxim Tours represents only carefully vetted properties, it is not responsible for the physical condition and maintenance of the rooms, properties, facilities and services used in the itinerary. All complaints regarding individual hotels, lodges, safari camps or services during your trip must be put in writing and registered with the property or company involved at the time of the event. Travelers must retain a copy of the written complaint along with a written acknowledgement of the complaint from the property or company involved. Maxim Tours Ltd is unable to pursue any compensation without this documentation.  Specific room and bed types are never guaranteed.

Cancellations:

Every trip itinerary and its components has particular conditions and policies regarding cancellation. In addition to any cancellation penalties related to non-refundable components (e.g. permits, airfare, hotel, tour, etc.), the following fees will apply, 60 days or more prior to the trip start date the deposit is forfeited, 59 days or less prior to the trip start date, all payments are non-refundable. Our cancellation penalties apply as soon as we have received a deposit or payment. Payment of a deposit constitutes an acknowledgement of all terms and conditions as described here. Cancellations for any reason whatsoever, including medical reasons, death in the family, strikes, wars, weather, natural disasters, airline default, pandemics or government travel warnings will not entitle you to any refund in the case of non-refundable reservations. Trip cancellation and interruption insurance is therefore highly recommended.

Responsibility/Release and Assumption of Risk:

I understand and am aware that during the travel itinerary in which I will participate under the arrangements of Maxim Tours Ltd. (hereinafter referred to as the Company), and its agents, associates, affiliated companies, or subcontractors, certain risks and dangers may arise, including but not limited to the hazards of traveling in unsafe areas or under unsafe conditions, the hazards of traveling in politically unstable areas, the dangers of civil disturbance and war, the forces of nature, the negligent or reckless acts or omissions of, and/or the bankruptcy, insolvency or cessation of services by, the Company’s affiliated companies, hotels, tour operators or subcontractors. In consideration of, and as part of the payment for, the right to participate in such travel itineraries, I have and do hereby expressly assume all of the above risks. The terms of this agreement shall serve as a release and express assumption of risk for myself, my heirs, assignee's, administrators, executors, and all members of my family, including any minors or non-family members accompanying me. I have read and fully understand the provisions and the legal consequences of this Release and Assumption of Risk and I hereby agree to all its conditions, especially noting and agreeing to the portion of this provision that releases the Company and its agents, employees, officers, directors, associates, affiliated companies, and subcontractors, to the extent permitted by law, from liability for the negligent or reckless acts or omissions of the Company’s affiliated companies, airlines and subcontractors.

Maxim Tours Ltd. is in all respects the agent of the client. Maxim Tours Ltd. books transportation, accommodation, adventure activities and other services from various foreign, independent ground operators/suppliers, who are not subject to the control of Maxim Tours Ltd.   Client travel arrangements are accepted by Maxim Tours Ltd. as agent for these independent operators.  Services provided by these operators/suppliers are offered subject to the terms and conditions contained in the tickets, itineraries or booking confirmations issued by them.   Although Maxim Tours Ltd. has made every attempt to retain the services of experienced, competent, and trustworthy ground operators it CANNOT BE LIABLE FOR ANY PERSONAL INJURY, FINANCIAL DEFAULT OR PROPERTY DAMAGE which may occur due to: 1) wrongful, negligent or arbitrary acts or omissions on the part of a supplier, its employees and others not under the direct control of Maxim Tours Ltd.; or 2) defects or failure of any aircraft, vessel, vehicle or other equipment or closure of property or inability to provide services instrumentally under control of independent suppliers; or 3) acts of god, including but not limited to natural disasters or public health pandemics.

Dispute Resolution:

In the unlikely event of a dispute between myself and Maxim Tours Ltd, the dispute will be submitted for binding arbitration in New Jersey, the dispute will be governed by New Jersey law, and the maximum amount of recovery shall not exceed the total amount of payments made.


The following applies to Airfare bookings:

Baggage: Check with your specific airlines. Most domestic US carriers and some international carriers now charge for each piece of checked baggage. For most international flights baggage is limited to a total of 20 kg. (44 lbs.), total of all pieces and items including carry-on items. If you plan to check and/or carry on more than 20 kg. of luggage per person on any of your flights, check directly with each airline in advance for their free baggage limits and excess baggage charges.

Reconfirming Flights/Tickets: Maxim Tours Ltd. will do its best to monitor flights but takes no responsibility for reconfirming your flights or for advising you of airline schedule changes once your tickets have been issued. Standard airline rules in effect in most countries require that international flights must be reconfirmed directly with the airlines concerned at least 72 hours prior to departure of each flight or the airline(s) may cancel your reservations. You should plan on contacting each airline concerned by phone or at a city ticketing office at least three days before your flight to reconfirm and check for any schedule changes. We recommend that you reconfirm each flight, even if the airline says that it is not required.

Airline Default/Involuntary Schedule Changes: We take no responsibility in the event of an airline’s default, cessation of service on a ticketed route or schedule change. Travel insurance that covers airline default is highly recommended.

Cancellations: Cancellation penalties apply as soon as we have received payment. Some tickets are completely non-refundable. Cancellations for any reason whatsoever, including medical reasons, death in the family, strikes, wars, weather, natural disasters, airline default or government travel warnings will not entitle you to any refund in the case of nonrefundable tickets. Trip cancellation and interruption insurance is therefore highly recommended. For the best coverage, travel insurance should be purchased at the same time as your airline tickets.
